California Debt Collection Laws

All California residents are protected under the Fair Debt Collection Practices Act (FDCPA). The FDCPA is the federal law that debt collectors follow when collecting on a debt, regulating the times they can call, the information they must provide you, and how frequently they can contact you regarding a debt.

In addition to the federal FDCPA, California has its own debt collection law that expands on these federal protections – the California Fair Debt Collection Practices Act (CFDCPA). California’s FDCPA offers additional protections to California residents not covered under the federal FDCPA.

If you are a California resident, you are protected by both the FDCPA and the CA-FDCPA.

What is the "CA-FDCPA?"

In addition to debt collector harassment, the CA-FDCPA protects consumers from unfair practices by original creditors, companies who make forms and tools used for debt collection, and attorneys and their staff who collect debts. The CA-FDCPA also applies to creditors who collect debts on their own behalf.

The CA-FDCPA may not cover occasional debt collectors, foreclosure, and/or commercial debts. Because of this, it is important that you bring your case to a qualified consumer attorney for evaluation as soon as possible, especially if you wish to take legal action under the FDCPA or CA-FDCPA.

The California Fair Debt Collection Practices Act is commonly referred to as the "Rosenthal Fair Debt Collection Practices Act" (RFDCPA).

FDCPA Guidelines in California

The FDCPA and CA-FDCPA are the basis for restricting and regulating the methods under which debt collectors can contact and communicate with you.

The FDCPA in California requires debt collectors to:

  • Refrain from using obscene or profane language.
  • Tell you who they are.
  • Use envelopes that do not indicate they are from a collector in an effort to protect the identity of the debtor.
  • Call ONLY between the hours of 8:00 am and 9:00 pm, unless you tell them otherwise.
